These Terms of Service ("Terms") constitute a legally binding agreement
between you ("User") and Ajna Softwares ("we", "us", "our")
governing your use of the Smart Alarm : Wake Up Challenge
Android application (package com.vk.alarm).
For all users: By using the app, you agree to be bound by these Terms and our Privacy Policy.
For users under 18: If you are a minor in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf. By allowing a minor to use the app, the parent or guardian agrees to these Terms and accepts responsibility for the minor's use.
Smart Alarm : Wake Up Challenge is available to users of all ages. There is no minimum age requirement to use the basic alarm, stopwatch, timer, and world clock features.
The app offers a one-time purchase to remove advertisements. Users under 18 must have parental or guardian consent before making any purchase. Parents and guardians are responsible for any purchases made by minors on their devices.

All purchases are processed securely through Google Play Billing. We do not receive, process, or store any payment card details. Google Play handles all payment information according to their security standards.
The price of the ad-free upgrade is displayed in the app in your local currency. Prices may vary by region and are subject to change. The applicable price at the time of purchase will be clearly displayed before you complete the transaction.

If you reinstall the app, switch devices, or clear app data, you can restore your previous purchase at no additional cost. Simply tap the "Restore Purchase" option in the app while signed into the same Google account used for the original purchase.

While we strive to deliver alarms reliably, we cannot guarantee alarm delivery under all conditions. Factors outside our control include:
SCHEDULE_EXACT_ALARM permission, alarms may not fire
on time.For critical wake-ups, always set a backup alarm using your device's built-in clock application.
On Android 13 and above, the app requests the
POST_NOTIFICATIONS permission to display upcoming alarm
reminders. This permission is optional — the app will still ring alarms
without it, but you will not receive advance reminder notifications.
You can grant or revoke this permission at any time in your device's
system settings.
Parents/Guardians: You can manage notification permissions on your child's device through Android's system settings.
All content within Smart Alarm : Wake Up Challenge — including but not limited to the app name, logo, UI design, challenge logic, sound assets, graphics, and source code — is the exclusive intellectual property of Ajna Softwares and is protected by applicable copyright, trademark, and intellectual property laws.
Nothing in these Terms transfers any intellectual property rights to you.

Parents/Guardians are responsible for monitoring their child's compliance with these conduct rules.
The app includes an optional Step Counter that uses your
device's hardware step sensor to count steps during a user-initiated walking
session. To use this feature on Android 10 and above, the app requests the
ACTIVITY_RECOGNITION permission. This permission is optional —
denying it disables step tracking only, and all other app features continue
to work normally.
The app also includes a Water Tracker for logging daily hydration. All fitness data — including step counts, calories, active minutes, and water intake logs — is stored locally on your device only and is never transmitted to any server.

Do not use this app as a substitute for professional medical advice, diagnosis, or treatment. Ajna Softwares is not liable for any health decisions made based on data shown in the app.
We are not liable for any damage to devices or injury to persons resulting from the use of physical wake-up challenges.
The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
To the maximum extent permitted by applicable law, Ajna Softwares and its affiliates, officers, employees, and agents shall not be liable for:
Our total liability to you for any claim arising from your use of the app shall not exceed the amount you paid for the ad-free upgrade, or zero if you have not made any purchase.
You (and the parent or guardian of any minor user) agree to indemnify and hold harmless Ajna Softwares and its affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your (or your child's) use of the app, violation of these Terms, or any unauthorised purchases.
We reserve the right to terminate or restrict your access to the app at any time, with or without notice, if we believe you have violated these Terms or applicable law.
You may terminate your use of the app at any time by uninstalling it. Note: Uninstalling the app does not entitle you to a refund for any purchase. Your purchase remains valid and can be restored if you reinstall the app.
Sections 9, 12, 13, and 14 survive termination.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. For changes that materially affect the rights of minors or the terms of purchase, we will provide prominent notice. Continued use of the app after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of India, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the app shall be subject to the exclusive jurisdiction of the competent courts located in India.
